| Internet Connectivity Service Agreement Important! Read this Agreement thoroughly, because the Customer's installation of ISP's software or use of ISP's service is deemed to be the Customer's acceptance of all the terms and conditions written in this agreement. DEFINITIONS i. "The Customer" is the individual, business or organization who installs the software provided by the ISP and/or uses the ISP's services (hereinafter referred to as "The Customer" or "Customer") ii. Internet Gateway Corporation is the company providing services to The Customer, having its place of business at #800-889 West Pender Street, Vancouver, British Columbia, V6C 3B2 (hereinafter referred to as "Internet Service Provider" or "The ISP" or "ISP") SERVICE The ISP agrees to provide The Customer with access to the global Internet in accordance with the type of software provided by the ISP to The Customer. The services provided to The Customer are described on the website www.fatwire.net. Technical support is provided for connectivity services only. ISP's responsibility shall be limited to the Customer's ADSL router or modem. All other equipment connected to the ADSL router or modem at the customer's premises will not be officially supported, nor will technical assistance be provided for it's configuration or maintenance. ISP shall not be obligated to provide other technical support unless it specifically agrees to it in writing. The Customer agrees that in the course of setting up, maintaining, or restoring service, ISP or its agents may require access to equipment and the telephone lines/system at The Customer's premises and may also need to suspend service for periodic maintenance. ISP may also require The Customer to deliver their computer to ISP's premises for servicing. TERM The Customer agrees that the minimum Term of service is six months. Payment for the minimum Term and advance cash payments are fully earned by the ISP and are non-refundable to The Customer. PAYMENT & CHARGES The Customer will pay ISP a monthly rental rate in accordance with the rates listed on the website www.fatwire.net. Payment shall be made on The Customer's Billing Date (defined below) by major credit card or pre-authorized debit payments from a chequing account directly. Payment by cash is acceptable for 1 Year Terms only, providing that each Term is paid in full and in advance, and provided the customer pre-purchases the ADSL router or "modem". Post-dated cheques are not accepted as payment. Any balance unpaid after the due date will be subject to a late payment charge of 2% per month (26.82% per annum). For each cheque and pre-authorized withdrawal transaction for which payment is refused, The Customer shall pay an administration fee of $20.00. For each change of User ID (also referred to as: username, account ID, login ID and other forms of uniquely identifying nomenclature) that is made to The Customer's account, The ISP will charge an administrative fee of $10.00. For each written complaint that The ISP receives, whether by e-mail, fax, or postal mail, as a result of The Customer's abuse of the service (where abuse is defined below in the section labeled Prohibitions), The Customer shall be charged an administrative fee of $10.00. ISP shall be entitled to change the monthly rental rate, service price plans, and services at any time upon 30 days' written notice to The Customer. Thereupon, The Customer may, in writing, terminate this Agreement within the 30-day period, otherwise the new terms and provisions shall apply. ISP reserves the right to charge a reconnection fee of $20.00 if the service has been disconnected due to non-payment. The ISP may terminate this Agreement without notice when The Customer is in breach of any of its obligations. The service provided by the ISP will be terminated for non-payment of accounts and will not be reinstated until payment is received in full. However, the ISP may refuse to reinstate the service and instead may simply choose to terminate this Agreement. The Customer may terminate this Agreement upon 10 days written notice to The ISP. No refunds will be given for payment made towards the unexpired portion of the Term. The Customer remains liable for unpaid accounts after Termination of this Agreement. Continued on PAGE
